CRAIG H. FOX is the managing shareholder of the Norristown, Montgomery County, Pennsylvania law firm of Fox and Fox Attorneys at Law. Within the Montgomery Bar Association, he served four consecutive terms as chairperson of the Collection, Foreclosure and Bankruptcy Committee; served as chairperson of the Debtor/Creditor Committee; was elected to serve on the Board of Directors; was appointed to serve on the Bench - Bar Committee; was appointed vice chair of the Business, Banking and Corporate Counsel Committee; and was appointed vice chair of the Professionalism Committee. Effective July 1, 2009, the Pennsylvania legislature has enacted a new law, entitled the Home Improvement Consumer Protection Act (“HICPA”) which may dramatically affect your business operations in the Commonwealth of Pennsylvania.

As of July 1, 2009, contractors conducting business with Pennsylvania homeowners must be in strict compliance with the extensive HICPA requirements or they may face legal action, including but not limited to potential civil penalties of $1,000.00 or more, or criminal prosecution which could lead to a misdemeanor or felony conviction.

In order to comply with HICPA, contractors dealing with Pennsylvania homeowners must complete a detailed registration process and conduct their business and interaction with homeowners with a detailed understanding of the requirements of HICPA to avoid these potential civil and criminal sanctions.

It is extremely likely that as of July 1, 2009, your company, at a minimum, will need to utilize new contracts, change operations relating to change orders and insure that supplemental information and disclosures are provided to your customers to comply with HICPA. HICPA also includes requirements which will likely affect your company’s marketing and advertising efforts. It is likely your company will be required to adjust payment schedules and other particulars relating to the scheduling of projects you are undertaking to avoid allegations of presumed fraud under HICPA.

IT IS IMPERATIVE THAT YOU ADDRESS YOUR COMPANY’S COMPLIANCE UNDER THE PROVISIONS OF HICPA IMMEDIATELY TO AVOID POTENTIAL CIVIL AND CRIMINAL LIABILITY.

As HICPA goes into effect on July 1, 2009, and your company must complete the extensive registration process and amend your form contracts prior to that date, time is running out.
